Introduction
Present terms and conditions serve as agreement between “Go East” and you regarding your group’s holiday and as such shall apply to all customers. No change to these terms and conditions shall apply unless a written agreement from the director of “Go East” is received. Terms “We”, “us” apply to “Go East” travelling agency; “you”, “group” apply to all persons travelling to Ukraine using our services. “Lead customer” is a person making the booking on behalf of the whole group. “Go East” undertakes all correspondence and conversations regarding arrangements for either an individual or group with the “lead customer”. A contract shall commence between us and you and your group upon issuance and delivery of your invoice.
“Go East” Travel Programmes
“Go East” Travel programme is facilitated by us in full especially for you. It will consist of the following elements: a) accommodations, b) transportation within Ukraine, c) additional services that will form a significant part of your holiday e.g. outdoor activities, sight-seeing tours etc. Please note that some activities you or any member of your group participate in might have active or dangerous nature and it is you and your group’s responsibility to act in accordance to the rules, regulations and instructions presented. Any injury you may bring upon yourself resulting from your or your group’s inadequate behaviour is your responsibility and you will not be entitled to compensation. We reserve the right to reject any booking for any individual for any tour or service.
Booking
The initial request and discussion of travel arrangements are done by e-mail. You will be further provided with proposed description of tour, quote per person and total price of service and a copy of our terms and conditions as soon as available. It is essential to provide us with details of each traveller correctly. Please note that services sold are subject to availability and can be withdrawn without notice. “Go East” reserves the right, without giving you notice, to vary any part of your booking, at any time, where such changes are minor. Confirmation of your booking is done in writing by letter, fax or e-mail. All our quotations are governed by our Terms & Conditions. By making a booking with us, whether by telephone, e-mail or in writing, you and all members of your group are understood to have accepted our terms and conditions and in the case of group bookings (2 persons & more), that the person making the booking is responsible for making all members of his or her group aware of these conditions. If you fail to return a signed copy of your confirmed booking form but submit money by way of a deposit or full balance we will assume you agree to all our terms and conditions.
Special Requests
Any special request with regards to room allocation or dietary preferences must be outlined in writing at the time of the booking. We will strive to fulfil all such requests, although we do not guarantee they will be possible.
Prices
All prices stated are per person in euro/ pound sterling unless specified otherwise on “Go East” web-site, invoice or receipt. Certain services require a group of 6 or more customers.
Deposit and Payments Schedule
Deposit payment is required for each group. Such payment should come from one source, lead customer or a person appointed by lead customer. Individual payments are not accepted. Contract is recognized once we receive a deposit payment from the lead customer of your group and issue a confirmation invoice. All inaccuracies in invoice should be reported back in three days after receipt, otherwise we hold no liabilities regarding this matter. “Go East” requires 50% deposit of the estimated amount four weeks before arrival to your holiday destination, Please note that each holiday is especially designed for your group therefore we retain the right to vary prices and amount of deposit as we see appropriate before final booking. We will confirm you of any such changes before final booking is done. All payments are done in two parts: 50% of the sum is wired to our banking account (data upon request), the remainder is paid cash after arrival to your holiday destination.
Cancellations:
By you
“Go East” will apply charges if you cancel your holiday with us. Charges are calculated as a percentage of your confirmed holiday price as stated in your final booking invoice. We reserve the right to keep the 50% deposit paid to us before, in case of cancellation.
By us
We reserve the right to cancel or modify itineraries or bookings under certain conditions. You will be refunded for minor changes and have an option to receive full refund and cancel your holiday with “Go East” in case you are not satisfied with changes done by us. “Go East” reserves the right to cancel your group’s holiday up to 40 days before your departure date.
Changes made by you
“Go East” will do its best to accommodate any changes done by you following deposit payment without additional charge, however in case additional charge is needed you will be notified separately. Final holiday itinerary should be confirmed three weeks before travel date. The original itinerary price is subject to the group size quoted; changes in group size are likely to influence prices.
Price Changes
Prices are formed based on costs at the time of booking. Since “Go East” is a travel agent, not a direct supplier of accommodations and activities, there is a slight possibility of price change. In such unlikely event you will be notified by “Go East” representative no later than 30 days before your group’s departure date. You will have 7 days to either agree or disagree to such changes. If you disagree you are free to cancel your holiday and receive full refund of costs paid to “Go East” or cancel certain elements of your booking. We will consider you accept new price if we receive no response from your side during 7 days after you have been notified of changes.
Force Majeure
Force majeure includes: war, threat of war, riots, civil disobedience or strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions, level of water, technical or maintenance problems with transport and changes of schedules or operational decisions of transport providers, closure of airports or any unforeseeable or unavoidable event beyond the control of “Go East” or its suppliers. We hold no responsibility for changes or cancellations due to these events that neither our suppliers nor us can foresee or avoid. Consequently, we will not consider any compensation requests.
Terms and Conditions of our suppliers
All our suppliers, such as hotels, activity providers, etc., have individual terms and conditions that should be respected and obeyed. Such terms and conditions are available upon request from “Go East” representative.
Availability of Services
In the unlikely event that our suppliers' availability of service or terms change after you have made a booking, we will strive to ensure the least possible disruption of your travel experience. Acting as travel agent, not first-hand service provider, we, however, will do our best to offer a substitute or will fully refund that part of booking in case of cancellation. However, refunds due to weather change beyond our control are not available.
Liability
“Go East” undertakes no liability for any act, omission or default, whether negligent or otherwise, of any of our suppliers. This includes damage or loss that is caused by the negligence, act or omission of any supplier or third party. We strongly recommend you take out insurance that covers you for these circumstances, for example baggage loss or damage. Please note that you and all members of your group undertake all activities at your own risk, therefore “Go East” accepts no liability for any illness, injury or death to you or any member of your group. If you are late for transfers you are liable to pay additional charges incurred by us as a result of your lateness.
Insurance
Ensuring adequate insurance protection is your and your group’s exceptional responsibility before travel. We recommend purchasing insurance policy to cover loss of deposit and other costs through cancellation, loss or damage to personal baggage and loss of money, medical expenses, and additional expenses to cover hotel accommodation and repatriation costs to your homeland country should any services need to be extended or curtailed due to illness or other insurable risk. All activities are done at each customer’s own insurance responsibility and any claims should be directed to the company providing the service. We take no responsibility for our suppliers. It is your responsibility to sign disclaimers presented to you for any activities deemed to be high-risk: e.g.: boxing, quad-biking, go-carting, paintball etc.
Personal data protection
“Go East” uses your name and personal information solely in processing your booking and complying with legal requirements. We may also use your information to notify you of any future “Go East” special offers or news unless you specially note that you do not wish to obtain such information. We will not disclose any personal information about you or any group member to a third party, unless it is essential in order to meet your requests with suppliers.
Behaviour
While travelling to Ukraine with “Go East” you and every member of your group is expected to behave respectfully to local laws, other people and environment. “Go East” and our suppliers hold the right to cancel your travel or any activity if in their opinion they cause distress, damage, danger or annoy customers, other members of the party, employees, property or anyone else. In such cases no refunds are available. Some hotels require a deposit at the time of arrival to ensure coverage of any damage done to hotel property. The deposit will be returned at the end of your visit, if no damage occurs. Please note that some activities offered to you and your team require high level of concentration and therefore should not be endured under alcohol or drugs. Suppliers providing activities hold the right to cancel your participation in activity without refund if you or any member of your group is found under alcoholic or drug consumption. If you are subject to arrest, or are prevented from travelling at the discretion of an airline or other transport providers, or if you are evicted from a hotel at the discretion of the hotel management, we will not refund any portion of the cost of your holiday and, if we incur any expense as a result of your behaviour, you will be obliged to compensate us for that expense.
Complaints
Please submit any complaints to a representative of “Go East” or in writing during following 15 days of your trip to Ukraine. “Go East” will do its best to solve any problems that occur.
Passports and Visas
Ukraine sets visa free regime for citizens of the United States of America starting 1st July 2005, citizens of Canada and Japan starting 1st August 2005, citizens of the European Union countries (except Republic of Bulgaria and Romania), Swiss Confederation and Liechtenstein starting 1st September 2005, citizens of the Principality of Andorra, Vatican (The Holly See), the Principality of Monaco, the Republic of Iceland, the Kingdom of Norway, the Republic of San Marino starting 1st January 2006. This regulation establishes visa-free regime of entry to Ukraine and transit through it territory for USA, Canada, Japan, EU (except Republic of Bulgaria and Romania), Swiss, Liechtenstein, Andorra, Vatican, Monaco, Iceland, Norway, San Marino passport holders who may stay in Ukraine up to 90 days. However, it is your responsibility to ensure that all members of your team hold international passports valid for at least 6 months by the time of your visit to Ukraine.
Tickets for specific events
We cannot be held responsible for any cancellations, re-scheduling, changes of venue or changes of cast made after the booking of your holiday for any specific event (e.g.: sporting). If you wish to cancel your travel arrangements due to performance change the stated terms and conditions for cancellation will apply.
Agency
“Go East” is a travel agent, not first-hand provider of services, including accommodations, transportation and various activities. Therefore, “Go East” has no responsibility for services provided or not provided by any party, standards of any service or their representation.
Laws
Because the provision of purchased services takes place in Ukraine, these Terms and Conditions have to be governed by the Law of Ukraine and both parties submit to the exclusive jurisdiction of the courts of Ukraine should any dispute arise as to the interpretation or performance with the Terms and Conditions.
